To be eligible for asylum in the United States, an individual must meet the definition of a refugee, which is someone who is unable or unwilling to return to their home country due to a well-founded fear of persecution based on one of the five protected grounds mentioned earlier. The individual must also apply for asylum within one year of arriving in the United States, unless they can show exceptional circumstances that prevented them from applying in a timely manner.

The Asylum Application Process

The asylum application process can be complex and time-consuming. To begin the process, an individual must first file an application with USCIS or EOIR, depending on whether they are filing affirmatively or defensively. The application must include a detailed declaration explaining the individual’s reasons for seeking asylum and how they meet the eligibility criteria.

After submitting the application, the individual will be scheduled for an interview with an asylum officer or immigration judge. During the interview, the individual will be asked questions about their application and their personal history. They may also be required to provide additional evidence to support their claim.

If the individual’s application is approved, they will be granted asylum and allowed to remain in the United States. If the application is denied, the individual may appeal the decision to the Board of Immigration Appeals (BIA) or file a new application for asylum.
